FIRST AMENDMENT TO THE FIRST RESTATEMENT OF

DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND

RESERVATION OF EASEMENTS FOR THE

MARINA PARK CONDOMINIUM ASSOCIATION 

  

 

 

This FIRST AMENDMENT TO THE FIRST RESTATEMENT OF DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND RESERVATION OF EASEMENTS ("Amendment") is made on February 28, 2003, by the Marina Park Condominium Association ("Association"), 

RECITALS

WHEREAS, on February 1, 1993, a First Restatement of Declaration of Covenants, Conditions, Restrictions and Reservation of Easements ("Declaration") for the Marina Park Condominium Association comprising certain portions of real property located in San Diego County, California, was executed and recorded as Instrument number 1993-0063992, in the official records of San Diego County. The property is described as follows:

 

Parcel No. 3, as shown on Parcel Map thereof No. 10732, filed on November 24, 1980, of Official Records in the Office of the San Diego County Recorder.

Parcel No. 4 of Parcel Map No. 10732, in the City of San Diego, County of San Diego, State of California, according to Map thereof, filed in the Office of the County Recorder of San Diego County, November 24, 1980, being a division of Block 3 8 and 43, together with those portions Of "F" and Columbia Street of New San Diego, according to Map thereof No. 456, by Gray and Johns, filed in the Office of the County Recorder of San Diego County.

 

WHEREAS, pursuant to Article XV, Section 15.1, the Association's members have affirmatively voted to amend sections of the Declaration as provided herein.

 

NOW THEREFORE, the Association hereby amends the Declaration as follows:

 

 

AMENDMENT

 

 

1.    Article VII, Section 7.1 (a) is hereby amended to read as follows:

 

a. The master or blanket policy of fire and casualty insuring all improvements, equipment and fixtures on the common area for the full insurable value.

 

2.     Article VII, Section 7.1(b) is hereby amended to read as follows:

 

b. A comprehensive general liability policy insuring the Association, its agents, the owners and their respective family members against any liability incident to the ownership or use of the common area or any other Association maintained real or personal property. The amount of the general liability insurance which the Association shall carry at all times shall not be less than $500,000, as required by the California Civil Code.

 

3.     Article VII, Section 7.5 is hereby amended to read as follows:

 

The unit owner shall separately insure his or her unit against loss by fire or other casually. Insurance maintained by the Association does not cover the owner's or occupant's personal liability for damages occurring within the unit. Every owner is responsible to maintain and therefore should insure his personal property and the interior of the floors, walls and ceilings of his unit against loss and obtain personal liability insurance.

This instrument has been executed as of the date first set forth above. I, the undersigned, do hereby certify:

 

1. That I am the duly elected and acting Secretary of the MARIN PARK

CONDOMINIUM ASSOCIATION, a California Nonprofit Mutual Benefit Corporation;

 

2. That the foregoing FIRST AMENDMENT to the FIRST RESTATEMENT OF DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND RESERVATION OF EASEMENTS comprising two (2) pages, constitutes the First Amendment to the First Restatement of Declaration of Covenants, Conditions, Restrictions and Reservation of Easements of the Association duly adopted by a vote of at least a majority of the voting power for the Association.
